Floor coating materials (up to a maximum of 5000 square feet) are warranted to the original consumer purchaser as follows:
Against peeling/delamination from the concrete for as long as the original consumer purchaser owns the home in which the floor coating materials were installed.
Against staining from incidental spills of oil, transmission fluid, radiator fluid, gasoline, and diesel that are promptly wiped up (within 20 minutes of a spill) for a period of ten (10) years from the date of substantial completion of Simply Construction LLC’s work.
Floor coating materials installed in commercial, industrial, or business use buildings (up to a maximum of 5000 square feet) are warranted to the original consumer purchaser against the following conditions for a period of three (3) years from the date of substantial completion of Simply Construction LLC’s work:
Peeling/delamination from the concrete.
Staining from incidental spills of oil, transmission fluid, radiator fluid, gasoline, and diesel that are promptly removed (wiped up within 20 minutes of a spill).
Floor coating materials (up to a maximum of 5000 square feet) are warranted to the original consumer purchaser against the following conditions for a period of three (3) years from the date of substantial completion of Simply Construction LLC’s work:
Peeling/delamination from the concrete.
Staining from incidental spills of oil, transmission fluid, radiator fluid, gasoline, and diesel that are promptly removed (wiped up within 20 minutes of a spill).
This Limited Warranty does not apply to, and Simply Construction LLC will not be responsible for, normal wear and tear, or any damage to floor coatings or other property caused by improper repairs made or attempted by anyone other than Simply Construction LLC, faulty maintenance, misuse, abuse, neglect, extreme temperatures, staining or peeling caused by cracking of the substrate, defective substrate, hydrostatic pressure, or moisture vapor transmission levels greater than eight (8) lbs., battery acid, brake fluid, or other industrial fluid, or as a result of any accident, casualty, or natural disasters.
Non-transferable, applicable only to the property owner at the time of contracting.
Warranty repairs do not extend the original installation or component warranty.
Labor for Repair/Replacement:
Free labor for garage floor coating or cabinet part replacement/repair for one (1) year from substantial completion.
Limited to material and labor costs.
Excludes normal wear and tear, damage from improper repairs, unauthorized maintenance, misuse, abuse, neglect, extreme temperatures, fire, water, accidents, or natural disasters.
Does not cover UV damage, fading, dampness, overloading, water spray, or flooding.
Replacement parts may vary in color.
Purchaser’s Exclusive Remedy and Limitation on Liability:
Limited Lifetime Warranty is the sole remedy, with a liability limit not exceeding repair or replacement cost.
Not liable for special or consequential damages.
The express limited warranty is the only warranty for provided services, products, and materials.
Simply Construction LLC disclaims all other warranties, including implied warranties of merchantability and fitness for a particular purpose.
Limitation on Liability:
Liability not exceeding the price of repair or replacement.
Not liable for special or consequential damages.
Provides specific legal rights; additional rights may vary by state.
Some states may not allow limitations on implied warranty duration or exclusion of incidental/consequential damages.
